THIS DOCUMENT SETS FORTH THE DISCLAIMER FOR THE NATIONAL VEHICLE CERTIFICATION PROGRAM, INC. (DBA NVCP CERTIFIED) (“COMPANY”, “WE”, “US” or “OUR”) WEBSITE WWW.NVCPCERTIFIED.COM AND/OR WWW.WECERTIFYYOURCAR.COM (“SITE(S)”), AND AFFILIATES.

NVCP Certified has developed a pre-owned vehicle certification program that is unique in many ways and is designed to help consumers protect their interests when buying or selling a pre-owned/ used automobile. Because of the uniqueness and scope of our program we have developed an association of various affiliated companies, and have established linking agreements with some or all including, but not limited to, AAMCO Transmissions, Inc., CARFAX, Inc., On-Site Analysis, Inc., Caregard Warranty Services, Inc., AFG Technologies, LLC., Centro Inspection Agency, Inc., EAA Inspection Services. These links are not endorsements or referrals of any products or services; they are merely informational resources. No claims, promises, or guarantees about the completeness, accuracy, content or quality of information contained in the links to and from our Site(s) are made.

By ordering a certification/inspection from us, you agree not to hold us or any of our affiliates employees, inspectors, or technicians liable for any mechanical, electrical, or any meticulously hidden or undetected damage on the vehicle or any other failures or physical damage that occur after the vehicle is inspected or certified, unless otherwise covered by a separate warranty or vehicle service contract. In the case of a separate warranty or service contract such hidden or undetected damage or any other failures or physical damage are subject to and bound by a separate written contract specific to that warranty or vehicle service contract. You also agree that you waive any rights to hold us or any of our affiliates, employees, inspectors, or technicians liable for any damages (personal or physical) sustained from any inspection or certification we perform on your behalf, at your request. Our certifications/inspections are based on the results of a series of industry leading automobile related services and technologies as outlined herein.

CARFAX Vehicle History Reports™. The first requirement in determining the eligibility of a vehicle for NVCP Certification is whether or not the vehicle to be certified is eligible for the CARFAX Buyback Guarantee™. If the vehicle to be certified does not meet the requirements as outlined by the CARFAX Buyback Guarantee™ program, the vehicle does not qualify for NVCP Certification but may qualify for a Premium Inspection as outlined in the Site(s). Our Site(s) contains links to other affiliated web sites, such as CARFAX, and you agree to defend, indemnify, and hold harmless our affiliates and their respective directors, officers, employees, and agents from and against any and all claims, actions, demands, damages, costs, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the links from our Site(s). You also agree to be bound by the CARFAX Buyback Guarantee™ Terms and Conditions when electing to determine the eligibility of a vehicle for NVCP Certification via a link to CARFAX from our Site(s).

Engine oil and transmission fluid analysis. Another unique feature of the NVCP Certification Program is the inclusion of the technology of fluid analysis in determining the quality and condition of the engine and transmission of the vehicle to be certified. If the vehicle to be certified does not meet the requirements, as outlined in our Site(s), with a Pass or Pass with fluid change result from the fluids extracted from the engine and/or transmission of the vehicle to be certified, the vehicle does not qualify for NVCP Certification but may qualify for a Premium Inspection as outlined in the Site(s). The fluid samples may be extracted from the vehicle in question by a technician at an authorized inspection station and the samples analyzed at an authorized inspection station on behalf of the NVCP Certification Program. You may also elect to have a mobile inspector come to your home or place of business to perform the Certification/inspection. In this case the mobile inspector will extract the fluid samples from the vehicle to be certified/inspected and ship those samples to our facility to be analyzed. The equipment used (MotorCheck) for the fluid analysis, whether at an authorized inspection station or at our facility, is manufactured, serviced, and maintained by On-Site Analysis, Inc. (OSA). The results of the fluid analysis are posted in a report as part of the NVCP Certification Program and are intended for informational purposes only as a result of your request for an NVCP Certification. You agree to defend, indemnify, and hold harmless our affiliates, which include any authorized inspection station or any authorized mobile inspector, and their respective directors, officers, employees, and agents from and against any and all claims, actions, demands, damages, costs, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of your request for NVCP Certification and performing the fluid analysis at your request. You also agree that the information provided as a result of the use of the MotorCheck equipment, for the fluid analysis portion of the certification process, is not a guarantee or warranty of any kind.

Visual and physical mechanical inspection. Any vehicle, regardless of age or mileage, can qualify for NVCP Certification as outlined in the Site(s). Vehicles that do qualify for NVCP Certification are eligible for either Gold or Silver Certification, or a Premium Inspection. Vehicles that do not qualify for NVCP Certification can still be inspected under the Premium Inspection level as outlined in the Site(s). Any one of the three certification/inspection levels require a visual and physical mechanical inspection all of which are performed by inspectors, technicians, or mechanics employed by one or more of the affiliated companies listed above. The inspectors, technicians, or mechanics “Inspector” that performs the visual and physical mechanical inspections are experienced automotive professionals and will provide their professional opinion on their findings about the vehicle. Our used vehicle inspections are based on what is seen and heard through the eyes and ears of the Inspector. During all inspections they will try to test drive most vehicles as a component of the inspection; a test drive may not be performed for a number of reasons. These reasons could include, but are not limited to; a refusal of the vehicle's current owner/seller to allow a test drive or drive the vehicle as owner and insured, safety issues, weather conditions (especially if it is a classic car inspection), if the vehicle does not have a valid registration or the minimum insurance required by law, and/or any other reason at our sole discretion. A test drive is not required for the Inspector to complete an inspection and if the Inspector is unable to perform a test drive for any reason we will try to reflect this in our reports. You agree to defend, indemnify, and hold harmless our affiliates and their respective directors, officers, employees, and agents from and against any and all claims, actions, demands, damages, costs, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of your request for NVCP Certification and/or a used vehicle inspection. You also agree that the information provided as a result of the visual and physical mechanical inspection is not a guarantee or warranty of any kind.

Our Company does not provide advice or express our opinion as to whether you should purchase or decline to purchase, or sell or decline to sell any vehicle we certify or inspect. Most certifications/inspections are completed within 48 to 72 hours (Monday through Friday except holidays) from the time you place your order for inspection or certification, and the reports and digital photos are made available at the earliest time possible (normally within 48 to 72 hours of the time the actual inspection or certification is performed). We do not guarantee the time to begin or complete a certification/ inspection due to certain unpredictable circumstances that must be taken into consideration including but not limited to; the available schedule of the consumer and the consumer’s ability or willingness to schedule an appointment in a timely manner with the Inspector for the certification or inspection; weather; acts of God. Cancellation of an inspection once it has been ordered and assigned may result in a refund or partial refund according to the terms of our Refund Policy. If you do not permit the inspector to perform any part of the certification or inspection or the entire certification or inspection, you will be liable for the entire cost of the certification or inspection. Furthermore you maybe charged the full price of certification/inspection should you elect to reschedule that certification/inspection. You agree that the vehicle to be certified or inspected must be cleaned of dirt, mud, debris, snow, ice, and any other material prior to the certification or inspection in order for the Inspector to provide an accurate inspection as to the condition of the body, paint and interior. Certain weather and lighting conditions may affect the accuracy of the inspection, and may affect the Inspector’s ability to perform an accurate inspection and/or take quality digital photographs.

We do our best to be certain that the certification/inspection performed will be accurate at the time of inspection as to the items listed on the various inspection reports and at the time the vehicle is certified or inspected, however, there are certain potential failures that are internal to various components (i.e. engine, transmission, driveline, electrical system, AC System, etc.) and there is the possibility of impending failures due to possible intermittent conditions that are not evident at the time of the certification/inspection or otherwise not presented or noticed during the certification/inspection process. Certain electrical or other functions may only be checked for the ability to "power on" such as CD Player or DVD Player and Navigation equipment. If the seller does not present a CD or DVD for the inspector to test for proper operation then it may not have been verified to operate as intended. We do not test for proper calibration of any electrical equipment including, but not limited to, fuel mileage monitors.

If an item is not listed on the inspection report then it was not inspected. Therefore, in no way does the certification/inspection and condition report constitute a guarantee or warranty that the vehicle will not breakdown in the future or have hidden damage, past or present, that was undetected during the inspection. You agree that we are providing you with the Inspector’s professional opinion as to the condition of the vehicle that is certified/inspected at the time of the certification/Premium Inspection. The Inspector’s opinion may differ from yours or any another person as if you or any other person were to inspect the same vehicle. Any guarantee as to the vehicle's condition when purchased or delivered will remain between the seller and the buyer. You agree that neither our company nor any of our affiliates and their respective directors, officers, employees, and agents will be held liable for any missed damages or failures, errors, or omissions. You must also acknowledge that certain weather conditions or the cleanliness of the vehicle may hinder the Inspector’s ability to detect imperfections with the vehicle such as previous body or paint work that may have been performed or interior defects. Cold weather may also prevent the ability to determine the performance of air conditioning system while under severe loads of high heat and humidity.

We provide a limited warranty that covers the internally lubricated components of the engine and transmission for a pre-determined period of time for vehicles that have qualified for a Gold or Silver Certification and where those certifications have been completed and the limited warranty registered into your name by our company. This limited warranty is a separate agreement between you and the administrator of the limited warranty, Prime Reserve Plus, and you agree that you are bound by the terms and conditions of the limited warranty (see dealer for details). You also agree to defend, indemnify, and hold harmless our company and our affiliates and their respective directors, officers, employees, and agents from and against any and all claims, actions, demands, damages, costs, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of your request for a Gold or Silver NVCP Certification resulting in the issuance of a limited warranty that covers the internally lubricated components of the engine and transmission only.

We may also offer for sale, vehicle service contracts (VSC) for most vehicles at an extra cost to you to help you protect your vehicle. The purchase of a vehicle service contract may extend additional protection in the event of a mechanical breakdown in the future. The extent of the coverage provided is subject to the terms and conditions of the vehicle service contract.

Our reports are for your information only and are NOT to be considered a recommendation for or against your decision to purchase or reject a vehicle; the decision to purchase or reject a vehicle needs to be made by you and you alone. By ordering a certification/inspection from our company you agree to this disclaimer and the terms and conditions listed in the Terms and Conditions on our Site(s).
